Welcome to Vietnam.travel, the official tourism portal of Vietnam. We are committed to protecting your privacy, ensuring the confidentiality of your personal information, and maintaining full transparency in how we collect, process, and safeguard your data.

This Privacy Policy applies to all visitors, users, and foreign travelers accessing our website ( vietnam.travel), mobile applications, and online tourism services (collectively, the "Platform").

1. LEGAL COMPLIANCE & FRAMEWORK

Our data processing activities are strictly conducted in compliance with applicable national and international privacy legal frameworks, including:

  • Vietnam Regulations:

    • Law on Personal Data Protection (Law No. 91/2025/QH15).

    • Decree No. 356/2025/NĐ-CP detailing the implementation of the Law on Personal Data Protection (replacing Decree 13/2023/NĐ-CP).

    • Law on Cybersecurity (Law No. 24/2018/QH14), Law on Information Technology, and Law on Protection of Consumers' Rights.

  • International Standards: Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR), California Consumer Privacy Act (CCPA/CPRA), and ePrivacy Directive.

2. TYPES OF DATA WE COLLECT

We categorize collected data into Basic Personal Data and Sensitive Personal Data in accordance with Decree No. 356/2025/NĐ-CP:

A. Basic Personal Data

  • Identity & Contact Details: Full name, date of birth, nationality, email address, phone number, passport number, and primary language preference.

  • Technical & Usage Identifiers: IP address, browser type and version, operating system, device identifiers, time zone setting, clickstream data, and interaction with interactive destination maps.

B. Sensitive Personal Data (Processed with Explicit High-Level Consent)

  • Precise Location Data: Real-time GPS location data when utilizing location-based destination guides or emergency medical assistance services.

  • Health/Access Requirements (Optional): Special medical or accessibility requirements voluntarily provided when requesting tailored travel support.

3. PURPOSES & LEGAL BASIS OF DATA PROCESSING

A. Purposes

  1. Service Provision: Delivering destination guides, travel updates, e-Visa information, and interactive portal tools.

  2. Personalization & Experience Enhancement: Tailoring travel recommendations, itinerary suggestions, and language settings to your preferences.

  3. AI & Virtual Tourism Services: Utilizing automated systems to provide automated travel assistance while maintaining algorithmic transparency.

  4. Communication & Emergency Support: Responding to inquiries, sending official travel advisories, and coordinating emergency medical/safety assistance.

  5. Security & Regulatory Compliance: Preventing fraudulent activities, fulfilling Transfer Impact Assessments (TIA), and complying with statutory obligations.

B. Consent Mechanisms

  • Explicit Opt-In: Processing relies on voluntary, explicit, and unbundled consent for specified purposes. Inaction, silence, or pre-ticked check-boxes are never deemed as consent.

  • Sensitive Data Notification: Prior to processing sensitive personal data, users are explicitly informed of the sensitive nature of such data as mandated by Decree 356/2025/NĐ-CP.

4. COOKIES & TRACKING TECHNOLOGIES

In accordance with Article 10 of Decree No. 356/2025/NĐ-CP:

  • Algorithmic Transparency: Where automated algorithms or AI-driven recommendations are used, users are informed of automated data processing, the general principles of the algorithms, and their impact.

  • Inference Data Protection: Any user profile inferences generated by AI that can identify a specific individual are protected under standard personal data rules.

  • User Control over Digital Footprints: Users retain full rights to edit, obscure, or request erasure of their digital interaction logs and historical profile data across our virtual/AR/VR environments.

6. ការចែករំលែកទិន្នន័យ និងការផ្ទេរឆ្លងដែន

ក. ការចែករំលែកទិន្នន័យ

ពួកយើង មិន លក់ ឱ្យជួល ឬជួញដូរទិន្នន័យផ្ទាល់ខ្លួនរបស់អ្នកឡើយ។ ទិន្នន័យអាចត្រូវបានចែករំលែកជាមួយ៖

  1. អ្នកផ្តល់សេវាដែលមានការអនុញ្ញាត៖ ហេដ្ឋារចនាសម្ព័ន្ធពពក វេទិកាចែកចាយអ៊ីមែល និងអ្នកផ្តល់សេវាវិភាគបច្ចេកទេសដែលដំណើរការក្រោមបទប្បញ្ញត្តិនៃកិច្ចព្រមព្រៀងកែច្នៃទិន្នន័យ (DPA) ដ៏តឹងរឹង។

  2. អាជ្ញាធររដ្ឋាភិបាល៖ ក្រសួងវប្បធម៌ កីឡា និងទេសចរណ៍ ក្រសួងសន្តិសុខសាធារណៈ (នាយកដ្ឋានសន្តិសុខអាយស៊ីធី និងការទប់ស្កាត់បទល្មើសបច្ចេកវិទ្យាខ្ពស់ - A05) ឬទីភ្នាក់ងារអនុវត្តច្បាប់ នៅពេលដែលច្បាប់តម្រូវ។

ខ. ការផ្ទេរទិន្នន័យឆ្លងដែន

ការផ្ទេរទិន្នន័យផ្ទាល់ខ្លួនក្រៅប្រទេសវៀតណាម គឺត្រូវអនុវត្តយ៉ាងខ្ជាប់ខ្ជួនតាមច្បាប់ស្តីពីការការពារទិន្នន័យផ្ទាល់ខ្លួនឆ្នាំ 2025 និងក្រឹត្យលេខ 356/2025/NĐ-CP៖

  • ការវាយតម្លៃផលប៉ះពាល់៖ សំណុំឯកសារវាយតម្លៃផលប៉ះពាល់នៃការផ្ទេរឆ្លងដែន (ទម្រង់បែបបទលេខ 09) ត្រូវ បានរក្សាបច្ចុប្បន្នភាព និងដាក់ជូនអាជ្ញាធរមានសមត្ថកិច្ច (A05)។

  • ការធានាផ្នែកផ្ទេរអន្តរជាតិ៖ លក្ខខណ្ឌកិច្ចសន្យាដ្ឋាន (SCCs) ត្រូវបានអនុវត្តសម្រាប់ការផ្ទេរទិន្នន័យដែលពាក់ព័ន្ធនឹងអ្នករស់នៅ សហភាពអឺរ៉ុប/តំបន់សេដ្ឋកិច្ចអឺរ៉ុប (EU/EEA) ក្រោមបទប្បញ្ញត្តិ GDPR។

7. ការរក្សាទុកទិន្នន័យ ការឆ្លើយតបចំពោះឧប្បត្តិហេតុ និងសុវត្ថិភាព

ក. ការរក្សាទុក និងការបោះចោល

ទិន្នន័យត្រូវបានរក្សាទុកត្រឹមតែរយៈពេលចាំបាច់ដើម្បីបំពេញគោលបំណងកែច្នៃដែលបានបញ្ជាក់ ឬបំពេញតាមតម្រូវការផ្លូវច្បាប់ប៉ុណ្ណោះ។ នៅពេលផុតកំណត់ ទិន្នន័យត្រូវបានលុបចោលដោយសុវត្ថិភាព បំផ្លាញចោល ឬធ្វើឱ្យអនាមិកដោយមិនអាចត្រឡប់វិញបាន ដោយប្រើប្រាស់ពិធីការលុបដែលមានការបញ្ជាក់។

ខ. ការជូនដំណឹងអំពីការបំពាន និងឧប្បត្តិហេតុ

ក្នុងករណីមានការបំពានទិន្នន័យផ្ទាល់ខ្លួន ឬឧប្បត្តិហេតុសុវត្ថិភាព៖

  • អាជ្ញាធរការពារទិន្នន័យមានសមត្ថកិច្ច (A05 - ក្រសួងសន្តិសុខសាធារណៈ) នឹងត្រូវបានជូនដំណឹងក្នុងរយៈពេល 72 ម៉ោង បន្ទាប់ពីបានរកឃើញ។

  • បុគ្គលដែលទិន្នន័យរងផលប៉ះពាល់ នឹងត្រូវបានជូនដំណឹងដោយគ្មានការពន្យារពេលមិនសមហេតុផល ដោយគូសបញ្ជាក់ពីហានិភ័យអាចកើតមាន និងវិធានការណ៍កែតម្រូវដែលបានអនុវត្ត។

8. សិទ្ធិផ្លូវច្បាប់របស់អ្នកក្នុងនាមជាម្ចាស់ទិន្នន័យ

ក្រោមច្បាប់ស្តីពីការការពារទិន្នន័យផ្ទាល់ខ្លួនឆ្នាំ 2025 (ច្បាប់លេខ 91/2025/QH15) ក្រឹត្យលេខ 356/2025/NĐ-CP និងបទប្បញ្ញត្តិអន្តរជាតិ (GDPR/CCPA) អ្នកមានសិទ្ធិដូចខាងក្រោម៖

  1. សិទ្ធិទទួលបានព័ត៌មាន៖ ការជូនដំណឹងច្បាស់លាស់ និងមានតម្លាភាពអំពីការកែច្នៃទិន្នន័យ មុនពេលប្រមូលផ្ដុំ។

  2. សិទ្ធិផ្តល់ការយល់ព្រម និងដកហូតការយល់ព្រម៖ សេរីភាពក្នុងការផ្តល់ បដិសេធ ឬដកហូតការអនុញ្ញាតកែច្នៃទិន្នន័យ។

  3. សិទ្ធិចូលមើល និងកែតម្រូវ៖ ពិនិត្យស្នើសុំច្បាប់ចម្លងអេឡិចត្រូនិក ឬកែតម្រូវទិន្នន័យផ្ទាល់ខ្លួនที่ไม่ត្រឹមត្រូវ។

  4. សិទ្ធិលុបចោល ("សិទ្ធិត្រូវបានបំភ្លេចចោល")៖ ស្នើសុំលុបបំបាត់ទិន្នន័យរបស់អ្នកជាអចិន្ត្រៃយ៍។

  5. សិទ្ធិកម្រិតការកែច្នៃ៖ ស្នើសុំកម្រិតបណ្តោះអាសន្នលើការកែច្នៃទិន្នន័យ។

  6. សិទ្ធិជំទាស់៖ ជំទាស់នឹងការកែច្នៃសម្រាប់ទីផ្សារផ្ទាល់ ការធ្វើទម្រង់ ឬគោលបំណងវិភាគ។

  7. សិទ្ធិផ្ទេរទិន្នន័យ៖ ទទួលបានទិន្នន័យរបស់អ្នកក្នុងទម្រង់អេឡិចត្រូនិកដែលមានរចនាសម្ព័ន្ធ និងស្តង់ដារ។

  8. សិទ្ធិដាក់ពាក្យបណ្តឹង និងស្វែងរកដំណោះស្រាយ៖ ដាក់ពាក្យបណ្តឹងផ្លូវការជាមួយស្ថាប័ននិយតកម្ម ឬស្វែងរកការជួយដោះស្រាយផ្នែកច្បាប់សម្រាប់ការរំលោភលើភាពឯកជន។

រយៈពេលឆ្លើយតប៖ នៅពេលទទួលបានសំណើរបស់ម្ចាស់ទិន្នន័យដែលមានសុពលភាព ពួកយើងនឹងឆ្លើយតប និងចាត់វិធានការក្នុងរយៈពេល 02 ថ្ងៃធ្វើការ (ឬតាមការកំណត់ដោយពេលវេលានៃនិយតកម្មដែលអាចអនុវត្តបាន)។

9. ការការពារអនីតិជន

វេទិការបស់យើងមិនកំណត់គោលដៅលើកុមារអាយុក្រោម 16 ឆ្នាំឡើយ។ ពួកយើងមិនដឹងខ្លួនជាមុនក្នុងការកែច្នៃទិន្នន័យផ្ទាល់ខ្លួនរបស់អនីតិជនដោយគ្មានការយល់ព្រមដែលអាចផ្ទៀងផ្ទាត់បានពីឪពុកម្តាយ ឬអាណាព្យាបាលស្របច្បាប់នោះទេ។ ប្រសិនបើពួកយើងរកឃើញការប្រមូលទិន្នន័យរបស់អនីតិជនដោយគ្មានការអនុញ្ញាត វានឹងត្រូវលុបចោលភ្លាមៗ។

10. ទាក់ទងមកយើងខ្ញុំ និងការអនុលោមតាមទិន្នន័យ
